Candidate EULA
Introduction
This End User License Agreement (“EULA” or “Agreement”) governs your use of the Atlast recruitment platform (the “Platform”) as a candidate. By accessing, browsing, or using the Platform, you accept and agree to be bound by all the terms and conditions of this Agreement.
If you do not agree to these terms, please do not use the Platform.
1. Definitions
“You” / “Candidate”: Any individual who accesses the Platform to view job opportunities, submit applications, or participate in the recruitment process.
“Company” / “Employer”: The organization that posts job opportunities on the Platform.
“Atlast”: Atlast Global Technologies, S.L., the provider and owner of the Platform.
“Platform”: The Atlast recruitment system accessible at www.atlasthq.com, including the careers page, application portal, interview tools, and candidate account features.
“Personal Data”: Any information that relates to you and can be used to identify you, such as your name, email address, phone number, CV, cover letter, test results, and interview feedback.
“Archived Data”: A record that you applied to a role, retained after your Personal Data is deleted (role name, company, application date only).
2. License Grant
Atlast grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for lawful purposes related to your job search and recruitment activities.
This license does not permit you to:
- Reproduce, distribute, or publish any part of the Platform
- Use automated tools (bots, scrapers, crawlers) to access the Platform
- Attempt to gain unauthorized access to the Platform or its systems
- Use the Platform for commercial purposes or on behalf of third parties
- Modify, adapt, or create derivative works from the Platform
- Reverse-engineer or attempt to discover the source code or algorithms
- Use the Platform to collect data about other users without consent
- Harass, intimidate, or threaten any other users or Atlast personnel
3. Intellectual Property Rights
3.1. Platform Ownership
Atlast retains full ownership of the Platform, including all software, design, features, functionality, and algorithms. You are granted only a limited license to use it as described in this Agreement.
3.2. Your Content Ownership
You retain ownership of any content you upload to the Platform, including:
- Your CV/resume
- Your cover letter
- Your responses to application questions
- Any other information you voluntarily provide
3.3. Atlast’s Right to Use Your Content
By submitting your application through the Platform, you grant Atlast and the relevant Employer a non-exclusive license to:
- Store and process your application materials
- Share your information with the Employer for recruitment purposes
- Use your information to operate and improve the Platform
- Use your information for legitimate interest purposes related to your application
You grant this license solely for the purposes of recruitment and the services provided by the Platform. Atlast will not use your information for any other purpose without your separate consent.
4. Data and Privacy
4.1. Data Ownership
You own your Personal Data. Atlast processes your data on behalf of the Employer as a data processor, in accordance with:
- Regulation (EU) 2016/679 (GDPR)
- Organic Law 3/2018 (LOPDGDD)
- UK Data Protection Act 2018 and UK GDPR (if applicable)
4.2. Data Usage
Your Personal Data will be used for:
- Processing your job application
- Communicating with you about your application status
- Conducting interviews and assessments
- Sharing your information with the Employer for hiring decisions
- Compliance with employment and legal obligations
Atlast will not use your Personal Data for marketing, profiling, or any purpose other than the recruitment process without your separate consent.
4.3. Data Retention and Deletion
Personal Data Retention:
- Your Personal Data (CV, contact information, test results, interview recordings) is retained while the job role is open
- 90 days after the role closes, your Personal Data is automatically deleted
- You will receive no further access to this data after deletion
Archived Records:
- After Personal Data deletion, you will see an “Archived Application” record in your candidate portal showing only: role name, company name, and application date
- This record is retained indefinitely in your portal for your reference and to prevent duplicate applications
- Archived records contain no Personal Data and are not accessible to the Employer
If a Role Reopens:
- If the same role reopens after 90 days, the Platform will notify you that you previously applied
- You can choose to apply again (resubmitting your Personal Data)
- Archived records are not reused; you submit fresh application materials
4.4. Your Data Subject Rights
You have the right to:
- Access: Request a copy of your Personal Data held by Atlast
- Rectification: Correct inaccurate or incomplete data
- Erasure: Request deletion of your data (will be honored within the retention period)
- Restriction: Request that processing be limited
- Portability: Receive your data in a machine-readable format
- Object: Object to processing based on legitimate interest
- Withdraw Consent: Withdraw any consent you have given

4.5. International Data Transfers
Your Personal Data may be transferred outside the European Economic Area only where appropriate safeguards are in place, such as Standard Contractual Clauses or adequacy decisions. For more information, see our Privacy Policy.
5. Artificial Intelligence and Automated Decision-Making
5.1. AI Usage on the Platform
The Platform uses artificial intelligence (AI) to support recruitment activities, including:
- Candidate profile matching and scoring
- Interview scheduling and coordination
- Feedback summarization and analysis
- Workflow automation and communication
5.2. Important Limitations
Atlast does NOT make hiring decisions. AI is used to support and assist the Employer’s recruitment process, but:
- All final hiring decisions are made by humans at the Employer
- AI scores and insights are recommendations only, not binding decisions
- You have the right to human review and intervention at any stage
- The Employer has full control over recruitment outcomes
5.3. Bias and Fairness
Atlast tests its AI systems for bias across protected characteristics including gender, ethnicity, age, and nationality. We work to minimize bias and ensure fair treatment. However, no system is perfect. If you believe you have been treated unfairly by our AI systems, you can:
- Contact the Employer directly
- Contact Atlast at privacyandsecurity [at] this domain
- Lodge a complaint with your local data protection authority
5.4. Right to Human Review
You have the right to request that a human review any AI-based assessment or score provided by the Platform. Contact the Employer to make this request.
6. Account and Access
6.1. Account Creation
To use certain features of the Platform, you may be required to create an account and provide accurate personal information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- Ensuring all information you provide is accurate and up-to-date
- Notifying Atlast of any unauthorized access to your account
6.2. Account Termination
You can delete your account at any time through your account settings. Once deleted:
- Your Personal Data will be scheduled for deletion (processed within 90 days)
- You will lose access to your candidate portal
- Archived application records will remain (without personal data)
Atlast may also suspend or terminate your account if you violate this Agreement or engage in prohibited conduct.
7. No Warranty and Disclaimer
7.1. Platform Provided “As-Is”
The Platform is provided “as-is” without warranties of any kind, express or implied. Atlast does not warrant that:
- The Platform will be uninterrupted or error-free
- Your applications will be reviewed or result in employment
- The information on the Platform is accurate or complete
- The Platform is free from viruses or harmful code
7.2. No Liability for Employment Outcomes
Atlast is not responsible for:
- Whether you are selected for interviews or hired
- Employment decisions made by Companies
- The terms, conditions, or legality of any job offer
- Communication delays or failures from Employers
- Discrimination or unfair treatment by Employers
- Any consequences of your employment or lack thereof
The recruitment decision is solely the responsibility of the Employer.
8. Limitation of Liability
To the maximum extent permitted by law, Atlast will not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of income, opportunities, or business
- Damage to your reputation
- Any damages arising from your use of the Platform or inability to use it
Atlast’s total liability under this Agreement will not exceed the fees you have paid Atlast (which, if you are a free user, is €0).
Some jurisdictions do not allow limitation of liability, so this limitation may not apply to you.
9. Prohibited Conduct
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on anyone’s intellectual property rights
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity
- Harass, defame, or threaten any other users or Atlast personnel
- Transmit malware, viruses, or harmful code
- Attempt to gain unauthorized access to the Platform
- Engage in any form of abuse or unlawful conduct
Violation of these terms may result in:
- Suspension or termination of your account
- Deletion of your data
- Legal action by Atlast or affected parties
10. Third-Party Links and Services
The Platform may contain links to third-party websites and services that are not operated by Atlast. This Agreement applies only to the Atlast Platform. You acknowledge that:
- Atlast is not responsible for third-party websites or services
- Third-party sites have their own terms of service and privacy policies
- Use of third-party services is at your own risk
11. Modification of Terms
Atlast may modify this EULA at any time. Your continued use of the Platform constitutes acceptance of the modified terms. Material changes will be communicated to you via email or prominent notice on the Platform.
The “Last Updated” date at the top of this Agreement will reflect any changes.
12. Governing Law and Dispute Resolution
This Agreement is governed by and construed in accordance with:
- The laws of Spain (specifically Catalonia)
- The Spanish Consumer Protection Regulations
- The GDPR and LOPDGDD
Disputes: Before pursuing legal action, we request a 30-day period of good-faith negotiation to resolve any disputes.
If negotiation fails:
- Spain: Disputes will be resolved in the courts of Barcelona
- UK: Disputes will be resolved in accordance with applicable UK law
13. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14. Entire Agreement
This EULA, together with our Privacy Policy, Candidate Privacy Notice, and Cookie Policy, constitutes the entire agreement between you and Atlast regarding your use of the Platform.

By using Atlast, you acknowledge that you have read, understood, and agree to be bound by this End User License Agreement.
